Spying on Journalists: Department of Justice (DOJ) Sets “Guidelines” Concerning Government Surveillance of Members of the Press

On Friday, the US Department of Justice (DOJ) released a memorandum setting forth new “guidelines” concerning government surveillance of members of the press. “These revised guidelines will help ensure the proper balance is struck when pursuing investigations into unauthorized disclosures,” announced Attorney General Eric Holder.

Billed on the front page of the New York Times as a major reform that “would significantly narrow the circumstances under which journalists’ records could be obtained,” the memorandum actually does nothing of the kind.

The memorandum (available here) resembles Holder’s previous work on the subject of military commissions, incommunicado detention, drones, and assassination. Couched behind weasel-words, vague loopholes, and conciliatory language, the Obama administration always goes out of its way not to concede any limits on its asserted powers.

As an initial matter, the idea that an internal Department of Justice memorandum could constitute a “reform” is a sham. If the Obama administration can “self-restrict” its activities, then it can just as easily “self-expand” them.

The memorandum itself, far from “tightening” restrictions on intelligence activities with respect to the press, actually further codifies a regime for spying on, bullying, and prosecuting members of the press who come into possession of information the executive branch has deemed “classified.”

The memorandum follows revelations that the Obama administration systematically targeted and spied on members of the press. In May, the Associated Press revealed that the Obama administration had secretly wiretapped more than 20 phone lines of its journalists, including home phones and cell phones. Associated Press president Gary Pruitt, in an open letter, denounced the Obama administration’s wiretaps as a “massive and unprecedented intrusion,” seeking information that “the government has no conceivable right to know.”

The DOJ memorandum has a strong component of damage control in the aftermath of the spying scandal. Under the circumstances, it is remarkable for what it does not say. The memorandum does not indicate that the Obama administration will cease its spying on journalists or its ruthless persecution of government whistle-blowers. In fact, the memorandum expressly reserves the power to continue spying on the press “when the information sought is essential to a successful investigation or prosecution.”

Contrary to the presentation of the memorandum in the corporate media, the memorandum does not even include any actual “guidelines.” The memorandum merely proposes that, at some point in the future, new guidelines and policies will be drafted and implemented (e.g., the “Department’s policies will be revised …;” “the Department would revise current policy …;” “the Department will require ;” etc.).

Among the changes proposed by the memorandum is an expanded mechanism for intimidating and threatening (“negotiating with”) journalists who come into possession of classified information. Pursuant to this regime, the journalist will receive an invitation to “negotiate” with the military-intelligence agencies. It is not that hard to guess at the content of any such negotiations (“hand over the files or else,” “tell us your source or else”). Notwithstanding this mechanism, the memorandum expressly reserves the power to spy on journalists without notice or negotiations.

The memorandum announces that the administration will expand its efforts to prevent leaks internally by withdrawing security clearances and imposing unspecified “other sanctions” against would-be whistle-blowers.

Also included are proposals to set up toothless, token committees and groups to advise the Attorney General with respect to press spying. The advice of these committees and groups will be non-binding, and the Attorney General will be free to disregard it. The memorandum would further require direct authorization from the Attorney General for many kinds of press surveillance.

In one significant passage, the memorandum expressly reserves the power to search and seize journalists’ records where there is “probable cause to believe that the person possessing such materials has committed or is committing a criminal offense to which the materials relate,” including “the receipt, possession, or communication of information relating to national defense, classified information, or restricted data.” This language is from the so-called Privacy Protection Act of 1980.

In the context of this memorandum, the citation of the phrase “committed or is committing a criminal offense,” is a threat not just to spy on journalists who publish classified information, but a threat to prosecute them as well.

The “balancing” of democratic rights against national security—the Obama administration’s standard refrain—features prominently in the memorandum. The memorandum announces that it “strikes the appropriate balance between two vital interests: protecting the American people by pursuing those who violate their oaths through unlawful disclosures of information and safeguarding the essential role of a free press in fostering government accountability and an open society.”

This framework, accepted uncritically by the press and academic commentators, is false and fundamentally undemocratic. Here, the reactionary campaign to kill or capture NSA whistle-blower Edward Snowden is placed on the scales and declared a “vital interest” of equal importance as the Bill of Rights.

In fact, these two supposedly “vital interests” cannot be reconciled. There is not an ounce of legitimacy to the Obama administration’s relentless pursuit and persecution of whistle-blowers such as Snowden, whose conduct has been perfectly legal. Meanwhile, the Bill of Rights expressly guarantees “the freedom … of the press” as well as the “right of the people to be secure in their persons, houses, papers, and effects.” These are absolute rights, not suggestions conditioned on other government interests.

The “balancing” formula, pursuant to which the president asserts the unilateral power to ignore the Bill of Rights in the name of national security, is a recipe for dictatorship.

In the final analysis, there is no reason even to accept the memorandum released Friday at face value. The Obama administration has repeatedly lied through its teeth as to the extent of its spying activities.

Absolutely no confidence can be placed in the promises of Obama, Holder, and the rest of the political establishment to “self-reform,” “self-regulate,” or otherwise impose “guidelines” on themselves. The Obama administration’s persecution of journalists and whistle-blowers does not need “guidelines.” It is illegal, it must be stopped, and the perpetrators must be held accountable.

The Obama administration has deliberately and repeatedly violated the Constitution, along with the basic rights of hundreds of millions of people in the United States and internationally.  

All of the top military, intelligence, and civilian officials in the American government, including Obama and Holder, deserve to be impeached, arrested, and prosecuted.

The Unspoken Truth: Coup d’etat in America

The American people have suffered a coup d’etat, but they are hesitant to acknowledge  it. The regime ruling in Washington today lacks constitutional and legal legitimacy.  

Americans are ruled by usurpers who claim that the executive branch is above the law and that the US Constitution is a mere “scrap of paper.”

An unconstitutional government is an illegitimate government. The oath of allegiance requires defense of the Constitution “against all enemies, foreign and domestic.” As the Founding Fathers made clear, the main enemy of the Constitution is the government itself.  Power does not like to be bound and tied down and constantly works to free itself from constraints.

The basis of the regime in Washington is nothing but usurped power. The Obama Regime, like the Bush/Cheney Regime, has no legitimacy.  Americans are oppressed by an illegitimate government ruling, not by law and the Constitution, but by lies and naked force. Those in government see the US Constitution as a “chain that binds our hands.”

The South African apartheid regime was more legitimate than the regime in Washington. The apartheid Israeli regime in Palestine is more legitimate.  The Taliban are more legitimate. Muammar Gaddafi and Saddam Hussein were more legitimate.

The only constitutional protection that the Bush/Obama regime has left standing is the Second Amendment, a meaningless amendment considering the disparity in arms between Washington and what is permitted to the citizenry. No citizen standing with a rifle can protect himself and his family from one of the Department of Homeland Security’s 2,700 tanks, or from a drone, or from a heavily armed SWAT force in body armor.

Like serfs in the dark ages, American citizens can be picked up on the authority of some unknown person in the executive branch and thrown in a dungeon, subject to torture, without any evidence ever being presented to a court or any information to the person’s relatives of his/her whereabouts.  Or they can be placed on a list without explanation that curtails their right to travel by air.  Every communication of every American, except  face-to-face conversation in non-bugged environments, is intercepted and recorded by the National Stasi Agency from which phrases can be strung together to produce a “domestic extremist.”

If throwing an American citizen in a dungeon is too much trouble, the citizen can simply be blown up with a hellfire missile launched from a drone.  No explanation is necessary. For the Obama tyrant, the exterminated human being was just a name on a list.

The president of the united states has declared that he possesses these constitutionally forbidden rights, and his regime has used them to oppress and murder US citizens. The president’s claim that his will is higher than law and the Constitution is public knowledge.  Yet, there is no demand for the usurper’s impeachment. Congress is supine. The serfs are obedient. 

The people who helped transform a democratically accountable president into a Caesar include John Yoo, who was rewarded for his treason by being accepted as a law professor at the University of California, Berkeley, Boalt school of law.  Yoo’s colleague in treason, Jay Scott Bybee was rewarded by being appointed a federal judge on the US Court of Appeals for the Ninth Circuit. We now have a Berkeley law professor teaching, and a federal circuit judge ruling, that the executive branch is above the law.

The executive branch coup against America has succeeded. The question is: will it stand? Today, the executive branch consists of liars, criminals, and traitors. The evil on earth seems concentrated in Washington.

Washington’s response to Edward Snowden’s evidence that Washington, in total contravention of law both domestic and international, is spying on the entire world has demonstrated to every country that Washington places the pleasure of revenge above law and human rights.

On Washington’s orders, its European puppet states refused overflight permission to the Bolivian presidential airliner carrying President Morales and forced the airliner to land in Austria and be searched. Washington thought that Edward Snowden might be aboard the airliner.  Capturing Snowden was more important to Washington than respect for international law and diplomatic immunity.

How long before Washington orders its UK puppet to send in a SWAT team to drag Julian Asange from the Ecuadoran embassy in London and hand him over to the CIA for waterboarding?

On July 12 Snowden met in the Moscow airport with human rights organizations from around the world. He stated that the illegal exercise of power by Washington prevents him from traveling to any of the three Latin American countries who have offered him asylum. Therefore, Snowden said that he accepted Russian President Putin’s conditions and requested asylum in Russia.

Insouciant Americans, and the young, unaware of the past, don’t know what this means. During my professional life it was Soviet Russia that persecuted truth tellers, while America gave them asylum and tried to protect them.  Today it is Washington that persecutes those who speak the truth, and it is Russia that protects them.

The American public has not, this time, fallen for Washington’s lie that Snowden is a traitor.  The polls show that a majority of Americans see Snowden as a whistleblower.

It is not the US that is damaged by Snowden’s revelations.  It is the criminal elements in the US government that have pulled off a coup against democracy, the Constitution, and the American people who are damaged. It is the criminals who have seized power, not the American people, who are demanding Snowden’s scalp.

The Obama Regime, like the Bush/Cheney Regime, has no legitimacy.  Americans are oppressed by an illegitimate government ruling, not by law and the Constitution, but by lies and naked force.

Under the Obama tyranny, it is not merely Snowden who is targeted for extermination, but every truth-telling American in the country.  It was Department of Homeland Security boss Janet Napolitano, recently rewarded for her service to tyranny by being appointed Chancellor of the of the University of California system, who said that Homeland Security had shifted its focus from Muslim terrorists to “domestic extremists,” an elastic and undefined term that easily includes truth-tellers like Bradley Manning and Edward Snowden who embarrass the government by revealing its crimes.  The criminals who have seized illegitimate power in Washington cannot survive unless truth can be suppressed or redefined as treason.

If Americans acquiesce to the coup d’etat, they will have placed themselves firmly in the grip of tyranny.

Two VERY troubling videos show Mark Dice campaigning people for their signatures to help the Obama administration to repeal the 1st amendment, as well as the Bill of Rights.  

He is VERY clear about what these petitions are about; mentioning the New World Order, and REPEALING the 1st Amendment, Stripping us of Free Speech, etc., and they just go on ahead and sign away, agreeing with him!!!? 

Without these rights, there IS NO America!  Is this what we have come to?  A nation of no-minds?  It appears that these people have no clue what it is that they are signing.

Without the Bill of Rights, OUR RIGHTS to free speech, a fair, public, and speedy trial, and protection from warrant-less searches and seizures, ARE FOREVER GONE.

We will no longer be protected from quartering of troops and cruel and unusual punishment, our right to petition, bear arms, have a trial by jury and more, WILL BE FOREVER GONE.

If these people that are signing these mock petitions, had their way, the first ten amendments to the Constitution would be repealed!!! America as we know it would cease to exist.

Caught on tape, executives at the Anglo-Irish bank were joking about how they convinced lawmakers to pay the bank with figures he “picked out of his arse”, with no plans to pay them back.  

Finally, a very embarrassing leaked conversation reveals perhaps the true mind and personality characteristics of a banker. Pulling money “out of ass”‘s , getting money for nothing. Be it fractional reserve banking, charging interest on money that doesn’t exist, or bailouts, these bankers surely all laugh at the ease at which they get free money. While these bankers laugh, homes are foreclosed upon, people starve and die all over the world, and poverty penetrates the core of humanity. Meanwhile, bankers pull “money out [their] ass”.

When you give many interviews in different countries and say essentially the same thing over and over, as I do, media outlets often attempt to re-package what you've said to make their interview seem new and newsworthy, even when it isn't. Such is the case with this Reuters article today, that purports to summarize an interview I gave to the daily newspaper La Nacion of Argentina.

Like everything in the matter of these NSA leaks, this interview is being wildly distorted to attract attention away from the revelations themselves. It's particularly being seized on to attack Edward Snowden and, secondarily, me, for supposedly "blackmailing" and "threatening" the US government. That is just absurd. 

That Snowden has created some sort of "dead man's switch" - whereby documents get released in the event that he is killed by the US government - was previously reported weeks ago, and Snowden himself has strongly implied much the same thing. That doesn't mean he thinks the US government is attempting to kill him - he doesn't - just that he's taken precautions against all eventualities, including that one (just incidentally, the notion that a government that has spent the last decade invading, bombing, torturing, rendering, kidnapping, imprisoning without charges, droning, partnering with the worst dictators and murderers, and targeting its own citizens for assassination would be above such conduct is charmingly quaint). 

I made three points in this La Nacion interview, all of which are true and none of which has anything remotely to do with threats:

1) The oft-repeated claim that Snowden's intent is to harm the US is completely negated by the reality that he has all sorts of documents that could quickly and seriously harm the US if disclosed, yet he has published none of those. When he gave us the documents he provided, he repeatedly insisted that we exercise rigorous journalistic judgment in deciding which documents should be published in the public interest and which ones should be concealed on the ground that the harm of publication outweighs the public value. If his intent were to harm the US, he could have sold all the documents he had for a great deal of money, or indiscriminately published them, or passed them to a foreign adversary. He did none of that.

He carefully vetted every document he gave us, and then on top of that, asked that we only publish those which ought to be disclosed and would not cause gratuitous harm: the same analytical judgment that all media outlets and whistleblowers make all the time. The overwhelming majority of his disclosures were to blow the whistle on US government deceit and radical, hidden domestic surveillance. 

My point in this interview was clear, one I've repeated over and over: had he wanted to harm the US government, he easily could have, but hasn't, as evidenced by the fact that - as I said - he has all sorts of documents that could inflict serious harm to the US government's programs. That demonstrates how irrational is the claim that his intent is to harm the US. His intent is to shine a light on these programs so they can be democratically debated. That's why none of the disclosures we've published can be remotely described as harming US national security: all they've harmed are the reputation and credibility of US officials who did these things and then lied about them.

2) The US government has acted with wild irrationality. The current criticism of Snowden is that he's in Russia. But the reason he's in Russia isn't that he chose to be there. It's because the US blocked him from leaving: first by revoking his passport (with no due process or trial), then by pressuring its allies to deny airspace rights to any plane they thought might be carrying him to asylum (even one carrying the democratically elected president of a sovereign state), then by bullying small countries out of letting him land for re-fueling.

Given the extraordinary amount of documents he has and their sensitivity, I pointed out in the interview that it is incredibly foolish for the US government to force him to remain in Russia. From the perspective of the US government and the purported concerns about him being in Russia, that makes zero sense given the documents he has.

3) I was asked whether I thought the US government would take physical action against him if he tried to go to Latin America or even force his plane down. That's when I said that doing so would be completely counter-productive given that - as has been reported before - such an attack could easily result in far more disclosures than allowing us as journalists to vet and responsibly report them, as we've doing. As a result of the documents he has, I said in the interview, the US government should be praying for his safety, not threatening or harming it. 

That has nothing to do with me: I don't have access to those "insurance" documents and have no role in whatever dead man switch he's arranged. I'm reporting what documents he says he has and what precautions he says he has taken to protect himself from what he perceives to be the threat to his well-being. That's not a threat. Those are facts. I'm sorry if some people find them to be unpleasant. But they're still facts. 

Before Snowden's identity was revealed as the whistleblower here, I wrote:
"Ever since the Nixon administration broke into the office of Daniel Ellsberg's psychoanalyst's office, the tactic of the US government has been to attack and demonize whistleblowers as a means of distracting attention from their own exposed wrongdoing and destroying the credibility of the messenger so that everyone tunes out the message. That attempt will undoubtedly be made here."
That's what all of this is. And it's all it is: an ongoing effort to distract attention away from the substance of the revelations. (This morning, MSNBC show host Melissa Harris-Parry blamed Snowden for the fact that there is so much media attention on him and so little on the NSA revelations: as though she doesn't have a twice-weekly TV show where she's free to focus as much as she wants on the NSA revelations she claims to find so important).

Compare the attention paid to Snowden's asylum drama and alleged personality traits to the attention paid to the disclosures about mass, indiscriminate NSA spying. Or compare the media calls that Snowden (and others who worked to expose mass NSA surveillance) be treated like a criminal to the virtually non-existent calls that Director of National Intelligence James Clapper be treated like a criminal for lying to Congress.

This "threat" fiction is just today's concoction to focus on anything but the revelations about US government lying to Congress and constitutionally and legally dubious NSA spying. Yesterday, it was something else, and tomorrow it will be something else again. As I said in an interview with Falguni Sheth published today by Salon, this only happens in the US: everywhere else, the media attention and political focus is on NSA surveillance, while US media figures are singularly obsessed with focusing on everything but that. 

There are all sorts of ways that Snowden could have chosen to make these documents be public. He chose the most responsible way possible: coming to media outlets and journalists he trusted and asking that they be reported on responsibly. The effort to depict him as some sort of malicious traitor is completely negated by the facts. That was the point of the interview. If you're looking for people who have actually harmed the US with criminal behavior, look here and here and here - not to those who took risks to blow the whistle on all of that. As always, none of this will detain us even for a moment in continuing to report on the many NSA stories that remain.

The original La Nacion interview which Reuters claimed to summarize is now online; the rough English translation is here. Here's the context for my quote about what documents he possesses:

"Q: Beyond the revelations about the spying system performance in general, what extra information has Snowden?
"A: Snowden has enough information to cause more damage to the US government in a minute alone than anyone else has ever had in the history of the United States. But that's not his goal. [His] objective is to expose software that people around the world use without knowing what they are exposing themselves without consciously agreeing to surrender their rights to privacy. [He] has a huge number of documents that would be very harmful to the US government if they were made public."
And exactly as I said, the answer about the dead man's switch came in response to my being asked: "Are you afraid that someone will try to kill him?" That's when I explained that I thought it was so unlikely because his claimed dead man's switch meant that it would produce more harm than good from the perspective of the US government. The only people who would claim any of this was a "threat" or "blackmail" are people with serious problems of reading comprehension or honesty, or both.

Zimmerman Verdict: "Not Guilty" This is a Frightening State of Affairs


To have the jury come back with a "Not Guilty" decision for Zimmerman is a frightening state of affairs.  This means anyone in the state of Florida can follow a child teen; enough to frighten that teen, or any person for that matter, then create a physical confrontation with that person, and if that person fights back in fear or defense, they can legally assassinate that child or innocent person.

This is further proof that our justice system is in a sorry state of affairs, and that the average person in this country is no longer thinking with compassion, or conscience; as this jury of 6 women has shown.


I was shocked when I first heard the verdict last night, then the shock was replaced with fear and an overwhelming sadness.

This is supposed to be the 21st century; not the 18th century of the "Wild West" era.

Yes, we do need to be able to possess guns, but stricter laws need to be in place to prevent something like this verdict of no responsibility for the killing of an innocent child or any person.  This is a travesty of the lack of respect for the importance of a human life.

Another sad possibility here, is that the Obama administration may use this as another reason to go after our guns; our protection from a Government that has become far too big, and corrupt; working together with the criminal banking cabal.

How the People of Iceland GOT THEIR COUNTRY BACK From the Corrupt Leaders and Criminal Banksters... Why Did The Media Keep The Recent Peaceful Icelandic Revolution Quiet?

Did you know about the peaceful Icelandic revolution that took place over the last 5 years? 


If you didn’t, it is likely because it was never televised or talked about very much at all on mainstream news. One would have to be part of the right websites or pages to even find out that this has been going on. Why is this the case? Why keep something so monumental hidden from the public?

First let’s discuss what took place with this revolution, then it will become much more clear as to why this was never televised.

It was during a time of a lot of financial turmoil around the world and stories were popping up all over the news of how banks around the world had been crushing or minimizing rebellions by receiving massive bailouts to keep them alive. 

The Iceland story is different because there was no crushing or ending the rebellion, instead, the people rose up. This is why this was not seen on TV anywhere. If the rest of the world knew that the people won, it may give them some ideas. 

During the financial turmoil of 2008 and 2009, the people of Iceland forced their government and banks to resign. How did they do this? Peacefully. The following is a summation of what steps they took over a process of several years, and it all began with each one of them realizing this couldn’t continue.

2008 – The main bank of Iceland is nationalized. The Krona, the currency of Iceland devaluates and the stock market halts. The country is in bankruptcy.

2008 – Citizens rise up at Parliament and succeed in forcing the resignation of both the prime minister and the effective government. New elections are held.
Yet, the country remains in a bad economic situation. A Parliament act is passed to pay back 3,500 million Euros to Great Britain and Holland by the people of Iceland monthly during the next 15 years, with 5.5% interest.

2010 – The people of Iceland again take to the streets to demand a referendum. In January of 2010, the President of Iceland denies approval, instead announcing a popular vote on the matter by the people.


In March, a referendum and denial of payment is approved by popular vote of 93%. Meanwhile, government officials initiate an investigation to bring to justice those responsible for the crisis. Many high level executives and bankers are arrested. Interpol dictates an order to force all implicated parties to leave Iceland.

An assembly is elected to write a new constitution (based on that of Denmark) to avoid entrapments of debt based currency foreign loans. 25 citizens are chosen — with no political affiliation — out of the 522 candidates. The only qualifications for candidacy are adulthood and the support of 30 people. The constitutional assembly started in February of 2011. It continues to present ‘carta magna’ from recommendations provided by various assemblies throughout the country. Ultimately, it must be approved by both the current Parliament and the one created through the next legislative election.

It’s quite a story isn’t it? You can most definitely see at this point why this was not covered in newspapers, on radio networks and on television. Imagine seeing this story on TV several times each day wherever you live in the world; do you think the people would start to get ideas? Maybe try the same thing? Most definitely. There is always a constant push of fear, murders, anger, government success, health fallacies and false information, but never do we hear of stories that could be a threat to the system.

Another key factor of this revolution that we have to look at is that it did not come from a place of violence, bloodshed or anger. No guns or fighting! It was simply people getting together peacefully and working things out. This is something this entire world is capable of but believes is impossible. Humanity has been so programmed to give itself little credit in this department. We always hear about how we need to be governed, there are too many crazy people out there, we need a big brother keeping control. The truth is, without the confines and certain rules the system employs, we would be a much more peaceful people mainly because we are no longer acting in survival mode. Now I am not here to say that the system is the only issue because it isn’t, our programming is also very strong in what we have been taught and believe about ourselves. I am simply here to say, this programming can be broken and our consciousness can and is changing.

I also thought it was a big step to see Iceland employ a new means of choosing it’s leaders. Someone who is an adult and has 30 people supporting them can run. This is great as the only reason why we have educated politicians today is because the elite needs to know that these people are programmed to repeat this system. Generally they also have to have corporate affiliations as well so they know they can be controlled by money.

Now Iceland is proceeding to actually prosecute some of their formerly most powerful bankers and the Icelandic special prosecutor has stated that it very well may indict some 90 people. Meanwhile, over 200 people, including the former chief executives of Iceland’s three biggest banks, face criminal charges for their activities.
